You will take the file endorsed copy of the Claim and you cause it to be served on the defendant(s). You can do this in several different ways:

(1) You can do this by having a person who is not personally involved in the action personally serve the defendant and then, fill out a Proof of Service for you to return to the court. This is proof to the court that the defendant was served and on what date.

(2) You can also have the Sheriff’s Office serve the papers. There is a fee for this service unless you have a waiver of fees. If the Sheriff’s Office serves the paperwork, they will complete the Proof of Service for you.

(3) You can hire a private process server.

This can be a complicated process and must be done correctly. If you have any questions, you may contact the Small Claims Advisor.
